1. Agreement to Terms

1.1 Acceptance of Terms

By downloading, installing, accessing, or using Binge Study (the "App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1.2 Privacy Policy

These Terms incorporate our Privacy Policy by reference. By using the App, you also agree to our Privacy Policy, which describes how we collect, use, and protect your information.

1.3 Age Requirements

  • You must be at least 13 years old to use this App
  • If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf
  • If you are under 13, you are prohibited from using this App

1.4 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where feasible, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the modified Terms.

2. Service Description

2.1 Overview

Binge Study is an AI-powered study companion application that helps users prepare for exams by generating practice questions, tracking study progress, and providing adaptive learning experiences.

2.2 Core Features

Free users have access to:

Premium subscribers receive:

  • Document Upload: Upload PDFs and images for AI topic extraction (2 MB max per file, 10 pages max per PDF, 15 uploads/day, 150 uploads/month)
  • Offline Study: Pre-download questions for studying without internet (content retained for 90 days)

3. Account and Authentication

3.1 Anonymous Accounts

Binge Study uses anonymous device-based authentication:

  • We do not require your email address, phone number, or password
  • A unique anonymous identifier is automatically generated for your device
  • Your account is tied to your device installation

3.2 Data Storage

  • Most of your data (profile, exams, study progress, settings) is stored locally on your device
  • Uninstalling the App permanently deletes your local data
  • We cannot recover your data after you uninstall the App
  • Cloud-synced data is limited to referral tracking and subscription status

3.3 Subscription Restoration

If you reinstall the App or switch devices:

  • Active Premium subscriptions can be restored through App Store or Google Play
  • Referral-earned Premium time is tied to your device and cannot be transferred
  • Local study progress, exams, and settings cannot be restored

4. Subscription Terms

4.1 Subscription Plans

Both plans provide identical Premium features as described in Section 2.4.

4.2 Billing and Auto-Renewal

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Payment is charged to your Apple App Store or Google Play account
  • Renewal is charged at the then-current subscription rate
  • Price changes will be communicated in advance per Apple/Google policies

4.3 Cancellation

  • You may cancel your subscription at any time through your device's subscription settings:
    • iOS: Settings > [Your Name] > Subscriptions
    • Android: Google Play Store > Subscriptions
  • Cancellation takes effect at the end of your current billing period
  • No refunds or credits are provided for partial billing periods
  • You retain access to Premium features until the end of the paid period

4.4 Refunds

  • All refund requests must be directed to Apple (App Store) or Google (Play Store)
  • We do not process refunds directly
  • Refund eligibility is determined solely by Apple/Google policies
  • Contact Apple Support or Google Play Support for refund inquiries

4.5 Free Trials

If a free trial is offered:

  • Trial duration is specified at the time of subscription
  • Trials automatically convert to paid subscriptions unless cancelled before the trial ends
  • One free trial per Apple ID or Google account

5. Referral Program Terms

5.1 Program Overview

Share your unique referral code with friends to earn Premium time:

  • Referral Code Format: STUDY-XXXXXX (6-character alphanumeric suffix)
  • Share Methods: Copy code, share link, or use deep links

5.2 Rewards

  • Maximum accumulation: 365 days (1 year cap)
  • Rewards extend your current Premium expiration or start from the current date if not subscribed

5.3 Eligibility Rules

  • Each referral code can only be used once per device
  • You cannot use your own referral code
  • Referral codes must be validated against our backend server
  • Both the referrer and referee must have valid app installations

5.4 Fraud Prevention

  • Device identifiers are hashed (one-way encrypted) to prevent duplicate redemptions
  • We monitor for suspicious referral patterns
  • Creating multiple accounts or using emulators to self-refer is prohibited
  • Fraudulent activity may result in:
    • Immediate revocation of earned rewards
    • Termination of access to the App
    • Permanent ban from the referral program

5.5 Program Modifications

  • We may modify, suspend, or terminate the referral program at any time
  • Existing earned rewards will be honored unless obtained through fraud
  • Changes do not apply retroactively to legitimately earned rewards
  • We will provide reasonable notice of material changes when feasible

6. AI-Generated Content Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

6.1 Nature of AI-Generated Content

  • All study questions, explanations, and solutions in Binge Study are generated by artificial intelligence (Google Gemini)
  • Content is created dynamically based on your input topics and materials
  • AI-generated content is not pre-reviewed by human educators, subject matter experts, or our staff

6.2 Educational Supplement Only

Binge Study is designed as a supplementary study tool. It is NOT a replacement for:

  • Formal education and classroom instruction
  • Professional tutoring services
  • Official course materials and textbooks
  • Guidance from teachers, professors, or instructors
  • Standardized test preparation courses

6.3 No Guarantee of Accuracy

WE MAKE NO WARRANTY THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE.

  • AI-generated content may contain factual errors, outdated information, or inaccuracies
  • Questions may have incorrect answers or flawed explanations
  • Content may not align with your specific curriculum, syllabus, or examination requirements
  • Always verify information with authoritative sources such as textbooks, academic papers, or qualified instructors

6.4 Not Professional Advice

AI-generated content in Binge Study is NOT:

  • Medical advice
  • Legal advice
  • Financial advice
  • Professional advice of any kind

Do not make important decisions based solely on content generated by this App. Consult qualified professionals for matters requiring professional expertise.

6.5 User Responsibility

  • You are solely responsible for evaluating the accuracy and appropriateness of AI-generated content
  • You use AI-generated content at your own risk
  • We are not liable for any consequences arising from your reliance on AI-generated content
  • We recommend cross-referencing all study materials with official course content

6.6 AI Processing

  • Your study topics and uploaded materials are processed by Google Gemini AI
  • Processing occurs on Google's servers in accordance with Google's Terms of Service and Privacy Policy
  • We do not permanently store AI inputs or outputs on our servers

7. User Content and Intellectual Property

7.1 Your Content

You retain ownership of all content you create or upload to the App, including:

  • Documents (PDFs, images)
  • Exam names and topics
  • Profile information

By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

  • Process your content through AI services for the purpose of generating study materials
  • Store your content temporarily as needed for service delivery

This license terminates when you delete your content or uninstall the App.

7.2 Your Responsibilities

You represent and warrant that:

  • You have all necessary rights to any content you upload
  • Your content does not infringe any third-party intellectual property rights
  • Your content does not contain illegal, harmful, defamatory, or offensive material
  • Your content does not include personal data of third parties without their consent

7.3 Our Intellectual Property

The following are the exclusive property of Arseniy Arsentyev PE:

  • The Binge Study application, including its design, code, and architecture
  • The Binge Study name, logo, and associated trademarks
  • Our proprietary algorithms and learning systems

You may not use our trademarks without prior written permission.

7.4 AI-Generated Content Ownership

  • AI-generated questions and content have no attributed copyright ownership under current law
  • You may use AI-generated content for personal educational purposes
  • You may not commercially redistribute, sell, or republish AI-generated content in bulk

7.5 Feedback

Any feedback, suggestions, or ideas you provide to us may be used without compensation or attribution. By submitting feedback, you grant us a perpetual, irrevocable license to use such feedback for any purpose.

8. Acceptable Use Policy

8.1 Prohibited Activities

You agree NOT to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, disassemble, or extract source code from the App
  • Circumvent, disable, or interfere with rate limits, quotas, or subscription restrictions
  • Create multiple accounts to abuse the free tier or referral system
  • Use automated scripts, bots, scrapers, or other automated means to access the App
  • Share your subscription credentials with others (subscriptions are for single-user use only)
  • Upload malicious files, viruses, or harmful code
  • Interfere with the security, integrity, or availability of the App
  • Resell, sublicense, or commercially exploit the App or its content
  • Impersonate any person or entity
  • Harvest or collect user information without authorization

8.2 Rate Limits

To ensure fair usage and service quality for all users:

BINGE STUDY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 Specific Disclaimers

We do not warrant that:

  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from the App will be accurate, reliable, or complete
  • Any errors in the App will be corrected
  • The App will be compatible with your device, operating system, or network
  • The App will be free from viruses, malware, or other harmful components
  • Third-party services (Google AI, RevenueCat, Firebase) will be continuously available

9.3 Third-Party Services

The App relies on third-party services including:

  • Google/Firebase: AI processing, authentication, backend services
  • RevenueCat: Subscription management
  • Mixpanel: Analytics (optional, can be disabled)

We are not responsible for outages, changes, or discontinuation of third-party services. Each third-party service is governed by its own terms and privacy policies.

10. Limitation of Liability

10.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARSENIY ARSENTYEV PE BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Damages arising from AI-generated content inaccuracies or errors
  • Damages exceeding the total amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater

10.2 Exclusions

This limitation of liability does not apply where prohibited by law, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Any other liability that cannot be excluded or limited under applicable law

10.3 Essential Purpose

These limitations apply even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Arseniy Arsentyev PE and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Content you upload or submit to the App
  • Your participation in the referral program
  • Any misrepresentation made by you

This indemnification obligation will survive termination of these Terms.

12. Account Termination

12.1 Termination by You

  • You may stop using the App at any time
  • To fully terminate your account, uninstall the App from your device
  • Uninstalling the App permanently deletes your local data
  • Important: Cancel any active subscriptions separately through your device settings to prevent future charges

12.2 Termination by Us

We may suspend or terminate your access to the App, without prior notice or liability, if you:

  • Violate these Terms or the Acceptable Use Policy
  • Engage in fraudulent referral activity
  • Abuse the App in ways that harm other users or our services
  • Are required by law or legal process to have your access terminated

12.3 Effects of Termination

Upon termination:

  • Your right to access Premium features ceases immediately
  • You remain liable for any subscription charges incurred before termination
  • We may delete any data associated with your anonymous identifier
  • Provisions that by their nature should survive will survive, including: Sections 6-11 (Disclaimers, IP, Liability, Indemnification), Section 13 (Dispute Resolution), and Section 18 (General Provisions)

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law provisions, except where overridden by mandatory local consumer protection laws.

13.2 Informal Dispute Resolution

Before filing any formal claim, you agree to attempt informal resolution by contacting us at ars.arsentyev@gmail.com. We will attempt to resolve disputes informally within 30 days.

13.3 Arbitration Agreement (United States Users)

For users located in the United States:

  • Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through binding arbitration
  • Arbitration shall be conducted under the rules of the American Arbitration Association (AAA)
  • Arbitration shall take place in a location mutually agreed upon, or via video conference

For users located outside the United States:

  • The courts of the Russian Federation shall have exclusive jurisdiction over any disputes

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arseniy Arsentyev PE regarding the use of the App and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. App Store Compliance Addendum

20.1 Apple App Store

If you downloaded the App from the Apple App Store:

  • These Terms are between you and Arseniy Arsentyev PE, not Apple Inc.
  • Apple has no obligation to provide maintenance, support, or warranty services for the App
  • Apple is not responsible for addressing any claims by you or any third party relating to the App
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claim
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

20.2 Google Play Store

If you downloaded the App from Google Play:

  • These Terms are between you and Arseniy Arsentyev PE, not Google LLC
  • Google has no obligation to provide maintenance, support, or warranty services for the App
  • Google is not responsible for addressing any claims relating to the App
