Terms of Service for Binge Study

1. Agreement to Terms

By downloading, installing, or using Binge Study (the "App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

Age Requirement: You must be at least 13 years old. Users aged 13-17 must have parental consent. Users under 13 are prohibited from using the App.

We may modify these Terms at any time. Material changes will be communicated via the "Last Updated" date and in-app notifications where feasible. Continued use constitutes acceptance.

2. Service Description

Binge Study is an AI-powered study companion that generates practice questions, tracks progress, and provides adaptive learning experiences.

2.1 Freemium Model

Binge Study offers a free tier with core study features and a premium subscription for full access.

Free Tier (no account required):

Learn mode with AI-generated questions (20 questions per day)
First chapters of roadmaps
Trophies and achievements
All data stored locally on device only

Premium Subscription:

Unlimited questions, solutions, and exam decks
Up to 10 topics per session
Full Roadmap Access (70+ roadmaps, all chapters)
Leagues (leaderboards and social features)
Cloud Sync across devices
Document Upload (20 MB/file, 50 pages/PDF, 15/day, 150/month)
Exam Attachments (up to 5 files per exam, stored locally on device)
Offline Study (content retained 90 days)

2.2 Free Trial

New users may start a 7-day free trial. The trial provides full access to all premium features. At the end of the trial, the subscription automatically converts to a paid plan at the selected rate ($4.99/month or $34.99/year) unless cancelled at least 24 hours before trial expiry. You can cancel the trial at any time via your device's subscription settings.

3. Account and Authentication

3.1 Authentication Methods

The App does not require an account to use free features. All data is stored locally by default. You may optionally create an account via Email/Password, Google Sign-In, or Apple Sign-In to enable cloud sync (premium) and social features.

3.2 Data and Account Limitations

Uninstalling deletes all local data regardless of account type. We cannot recover local data.
Free users (no account): Data is stored locally only. There is no cloud backup.
Premium subscribers with accounts: Data is synced to the cloud and restorable on new devices.

3.3 Account Deletion

Settings > Account > Delete Account (may require re-authentication). This deletes your Firebase Auth record, all cloud data, public profile, and friend connections. Subscription records (Apple/Google) must be cancelled separately. Analytics data retained per third-party policies. For complete deletion including analytics, contact info@bingestudy.app.

4. Subscription Terms

4.1 Plans and Billing

Monthly (billed every 30 days) and Yearly (billed annually, discounted). Both provide identical Premium features.

Subscriptions auto-renew unless cancelled at least 24 hours before the billing period ends. Payment is charged to your App Store or Google Play account.

4.2 Cancellation and Refunds

Cancel anytime via device subscription settings (iOS: Settings > [Your Name] > Subscriptions; Android: Google Play > Subscriptions). Cancellation takes effect at the end of your paid period. No partial-period refunds. All refund requests must go through Apple or Google.

4.3 Free Trial

A 7-day free trial is available for new subscribers (see Section 2.2). The trial auto-converts to a paid subscription unless cancelled at least 24 hours before expiry. Trial availability may vary by region and is subject to App Store/Google Play policies.

5. Referral Program

5.1 Rewards

Share your unique 6-character alphanumeric referral code to earn Premium time:

Maximum 52 referrals (364 days of earned Premium). Earned Premium and paid subscriptions do not stack; the longer expiration applies.

5.2 Rules

One redemption per device per code
You cannot use your own code
Your referral code doubles as a friend code for social features
Fraudulent activity (multiple accounts, emulators, self-referrals) may result in reward revocation, program ban, or account termination

5.3 Program Changes

We may modify or terminate the referral program at any time. Legitimately earned rewards will be honored.

6. AI-Generated Content Disclaimer

ALL STUDY QUESTIONS, EXPLANATIONS, AND SOLUTIONS ARE AI-GENERATED (GOOGLE GEMINI) AND MAY CONTAIN ERRORS.

6.1 Key Limitations

AI content is not reviewed by human educators or subject matter experts
Content may contain factual errors, outdated information, or inaccuracies
Always verify with authoritative sources (textbooks, instructors, academic papers)
Binge Study is a supplementary study tool, not a replacement for formal education, tutoring, or professional advice (medical, legal, financial, or otherwise)

6.2 Your Responsibility

You are solely responsible for evaluating accuracy. You use AI content at your own risk. We are not liable for consequences of reliance on AI-generated content.

6.3 AI Processing

Your topics and uploaded materials are processed on Google's servers per Google's Privacy Policy. Inputs and outputs are not permanently stored. See our Privacy Policy for details.

6.4 AI Content Labeling (EU AI Act & California SB 942)

Starting August 2, 2026, AI-generated content will be clearly labeled per EU AI Act (Article 50) and California SB 942 (as amended by AB 853). Labels will be mandatory and always visible for users in the EU and California as required by law. All other users can enable labels in Settings > Display > Show AI Content Labels.

Social features are opt-in only. Enabling them creates a public profile visible to other users (display name, photo, XP, streak, level, league tier).

Leagues: Premium users are placed into weekly league buckets of up to 16 participants, grouped by tier (Wooden, Bronze, Silver, Gold, Diamond). Each week, the top 4 participants are promoted to a higher tier and the bottom 4 are demoted to a lower tier. League standings reset weekly. League buckets may include simulated participants to ensure a competitive experience when fewer than 16 real users are in a bucket. Premium users receive no XP advantage.

Friends: Bi-directional system via referral codes. You can unfriend users at any time.

Opting out: Settings > Privacy > Social Features > toggle off. Your public profile and connections will be removed.

Restrictions: We may suspend social access for offensive content, harassment, league manipulation, or Acceptable Use violations (Section 9).

8. User Content and Intellectual Property

8.1 Your Content

You retain ownership of content you upload. Uploaded documents and exam attachments are stored locally on your device only and are never uploaded to our servers. Their content is transmitted to Google's AI services for topic extraction and study material generation. You grant us a limited, non-exclusive, royalty-free license to process your content through AI services for these purposes. This license terminates on deletion or uninstallation. You warrant that your content does not infringe third-party rights or contain illegal material.

8.2 Our Intellectual Property

The App, its design, code, name, logo, and trademarks are the property of Arseniy Arsentyev PE. AI-generated content has no attributed copyright under current law. You may use it for personal educational purposes but may not commercially redistribute it in bulk.

8.3 Feedback

Feedback you provide may be used without compensation or attribution.

9. Acceptable Use Policy

You agree not to:

Use the App unlawfully or violate applicable laws
Reverse engineer, decompile, or extract source code
Circumvent rate limits, quotas, or subscription restrictions
Create multiple accounts for abuse
Use bots, scrapers, or automated access
Share subscription credentials
Upload malicious files or interfere with App security
Resell or commercially exploit the App
Impersonate others or harvest user data

Rate Limits: 20 requests/minute, 200/hour, 500/day, 5 concurrent. Persistent abuse may result in account termination.

Document Upload Limits (Premium): 20 MB/file, 50 pages/PDF, formats: PDF/JPG/JPEG/PNG/WEBP/HEIC, 15/day, 150/month. Up to 5 attachments per exam.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, error-free, or secure operation; accuracy of results; or continuous availability of third-party services (Google/Firebase, RevenueCat, Mixpanel).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARSENIY ARSENTYEV PE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or goodwill
Damages from AI content inaccuracies
Damages exceeding the greater of: total amount paid in the 12 months preceding the claim, or $100 USD

These limitations do not apply where prohibited by law (e.g., death/injury from negligence, fraud, gross negligence).

12. Indemnification

You agree to indemnify and hold harmless Arseniy Arsentyev PE from claims arising from your use of the App, violation of these Terms, infringement of third-party rights, content you upload, or referral program participation. This survives termination.

13. Account Termination

By you: Stop using the App and uninstall. Cancel active subscriptions separately.

By us: We may suspend or terminate access without notice for Terms violations, fraud, abuse, or legal requirements. Upon termination, Premium access ceases immediately, and your data may be deleted. Sections 6, 8, 10-18 survive termination.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law provisions. EU/UK users retain statutory consumer rights under local law.

14.2 Informal Resolution

Before filing formal claims, contact info@bingestudy.app. We will attempt resolution within 30 days.

14.3 Arbitration (US Users)

Disputes shall be resolved through binding arbitration under AAA rules in Santa Clara County, California (or via video). Class Action Waiver: Disputes are resolved individually only. Small claims court remains available as an alternative.

14.4 Jurisdiction (Non-US Users)

Courts of Santa Clara County, California have jurisdiction. You may also bring claims in local courts where permitted by local law.

14.5 EU Alternative Dispute Resolution

EU/UK users: Online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obligated to participate.

14.6 Time Limitation

Claims must be filed within one year of arising or be permanently barred.

We process data based on contract performance, consent, and legitimate interests. You have rights to access, rectify, erase, port, object, restrict processing, and withdraw consent. International transfers are protected by Standard Contractual Clauses. See our Privacy Policy for full details.

16. CCPA/CPRA Terms (California Users)

You have the right to know, delete, correct, and opt-out of sale/sharing. We do not sell personal information. See our Privacy Policy for categories and details. To exercise rights: info@bingestudy.app (response within 45 days).

17. Children's Privacy (COPPA)

The App is for users 13 and older. We comply with the updated COPPA Rule (effective April 22, 2026). If we discover an underage user, access is terminated and all data deleted within 48 hours. Parents may contact info@bingestudy.app (subject: "COPPA Parental Request") to review, delete, or refuse collection of their child's data.

18. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
Severability: Unenforceable provisions are modified to the minimum extent necessary; remaining provisions continue.
Waiver: Failure to enforce a provision is not a waiver. Waivers must be written.
Assignment: We may assign these Terms. You may not without written consent.
Force Majeure: We are not liable for failures due to circumstances beyond reasonable control.
Language: English is the binding version. In-app translations are for convenience only.
Headings: For convenience only; do not affect interpretation.

19. Data Breach Notification

In the event of a data breach affecting your personal information, we will contain the breach, notify applicable authorities (within 72 hours for GDPR), and notify affected users via email or in-app notification. California users may request a detailed breach report at info@bingestudy.app.

Security vulnerabilities: Report to info@bingestudy.app (subject: "Security Vulnerability"). We will acknowledge within 48 hours.

20. Data Portability

You may request a copy of your data by emailing info@bingestudy.app or via Settings > Privacy > Export My Data. Requests are fulfilled within 30 days (GDPR) or 45 days (CCPA). Exports available once per month without charge.

21. Accessibility

We strive to meet WCAG 2.1 Level AA standards. The App supports screen readers (VoiceOver, TalkBack), dynamic text sizing, high contrast mode, and does not rely solely on color. Report accessibility issues to info@bingestudy.app (subject: "Accessibility Issue").

22. App Store Compliance

Apple App Store: These Terms are between you and Arseniy Arsentyev PE, not Apple. Apple has no obligation for maintenance, support, warranties, or IP claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

Google Play Store: These Terms are between you and Arseniy Arsentyev PE, not Google. Google has no obligation for maintenance, support, or warranties.

Third-party terms also apply: Google Cloud, Google Gemini AI, RevenueCat, Mixpanel.
